This privacy policy (this “Privacy Policy”) tells you about the information that Quarry Music LLC (the “Company,” “we” or “our”) collects in connection with the operation of its website, (the “Site”) and/or its mobile application Quarry (the “App”, and together with the Site, the “Platform”), how the information is used and how you can access and correct certain information that we may collect.

This Privacy Policy is effective as of May 18, 2015.


By using or interacting with the Site or the App or clicking the “I Accept” button, you agree to this Privacy Policy and consent to the use of your information as explained in this Privacy Policy. If you do not agree to this Privacy Policy, please do not hit the “I Accept” button or use the Site and/or the App. We reserve the right, in our discretion, to change, modify, add or remove portions of this Privacy Policy at any time and from time to time, without prior notice to you. All revisions will be posted to the Site and/or to the App. We urge you to review this Privacy Policy frequently for changes. Your continued use of or interaction with the Site and/or the App means that you accept those changes.


Registration data When you sign up for the Platform we may collect information we ask you for, such as your username, password, e-mail address and general location. When you connect to the Service using your Facebook credentials, you authorize us to collect your authentication information, such as your username, encrypted access credentials, and other information that may be available on or through your Facebook account, including your first name, last name, gender, general location, link to Facebook profile, timezone, birthday, and profile picture, and other items you provide us with permission to access through your Facebook account, including: country, hometown, e-mail address and date of birth. We may store this information so that it can be used for the purposes explained below. Usage & log data When you use the Platform, we automatically collect certain information, including: (i) information about your type of subscription and your interactions with the Platform, including with songs, playlists, other users, pages visited, content viewed, errors experienced; interactions with third party applications, websites and services featured on the Platform to make available products and services to you (“Third Party Applications”) and advertising, products and services which are offered, linked to or made available on the Platform; (ii) the details of the queries you make; (iii) Your Content (as defined in the Terms of Use); (iv) technical data, which may include the URL you are coming from, your IP address, unique device ID, network and computer performance, browser type, language and identifying information, transactional information enabling digital rights management, and operating system; and (v) location information. When logging in through Facebook, we may receive similar information related to your interactions with the Platform on Facebook. We may store this information so that it can be used for the purposes explained below. This information may be associated with your user account. In general, you can visit the Site (but not use the App) without telling us who you are or revealing personal information about yourself. In such case you will be unable to take certain actions, such as uploading Content, streaming Content, making purchases, participating in discussion boards, communicating with the Quarry Music artists etc.


We may use various technologies to collect and store information when you use the Site and/or the App. This information may include how many visitors log on, the geographic location of such visitors, the pages they access, the browser they use, their IP address etc. We may collect such information by sending one or more cookies or anonymous identifiers to your computer or mobile device, by installing “web beacons” (also known as: clear GIFs, pixel tags) on our Site and/or by other means. We use the information collected from you through cookies and web beacons to make your visit to the Site more enjoyable and meaningful to you. Cookies are text information files that your web browser places on your computer when you visit a website. Most browsers accept cookies automatically, but can be configured not to accept them or to indicate when a cookie is being sent. Please note that without cookies, you may not be able to take full advantage of all of the features of the Site or the App. Turning off the browser's cookies will prevent web beacons from tracking your specific activity. We may collect, maintain and use personally identifiable information collected about you, separately or on an aggregate basis in combination with pre-existing information, for the purposes stated below. To better meet your needs, we may supplement this information with information collected from third parties. To provide, personalize, and improve your experience with the Platform and products and services made available through the Platform, for example by providing customized or localized content and advertising; To identify you as the creator of the sounds that you upload, the comments that you post and/or the other contributions that you make to the Platform; To respond to your comments or requests for information; To ensure technical functioning of the Platform and products and services made available through the Platform, develop new products and services, and analyze your use of the Platform, including your interaction with applications, advertising, products and services that are made available, linked to or offered in the Platform; To communicate with you for Platform-related purposes, including promotional e-mails or messages; To provide any requested services; To provide other users with data regarding people streaming and downloading their sounds; To enable and promote the Platform, including features and content of the Platform and products and services made available through the Platform, such as sharing, user interactions, notifications and suggestions, and integration with third party services; To enforce this Privacy Policy, and the Terms of Use, including to protect the rights, property or safety of Quarry Music, users or any other person and the copyright-protected content of the Platform; and As otherwise stated in this Privacy Policy.

Your email address will be used to send you service updates and notifications regarding your account, and (if you have elected to receive them using your account preferences) newsletters, marketing messages and certain email notifications. Finding you and sharing within the Platform

The Platform offers many ways to find, enjoy, and share content, and we enable and encourage users to explore who else is using the Platform and their public profiles. Some of the information in your user account is publicly available to others by default, such as Facebook ID, profile picture, first name, last name and general location. We may use your public information to promote the Platform and to help others find you and/or your user account content, including through Facebook.

Sharing with Facebook

When you connect to the Platform using Facebook, you may choose a setting that instructs the Platform to share your activity and activity-related stories with Facebook, including the music you listen to. You understand that such information may be attributed to your account on Facebook and may be published on Facebook. See Section 8 below to learn how you can disable sharing of information on Facebook.

The Platform also enables you to share a particular item of content, on an individual basis, to other users by using the share functionality either on the Platform or on Facebook. Please note that sharing of such content on a Facebook may be posted as activity on Facebook, regardless of your account settings. We may store your username and an access token or similar credentials obtained from Facebook, so that you are able to share particular items of content, on Facebook, on an individual basis, without entering your access credentials again.

You understand and agree that Facebook’s use of information they collect from you is governed by their privacy policies, and our use of such information is governed by this Privacy Policy.

Sharing with Service Providers

We may from time to time engage third party service providers to perform functions and process user data, consistent with Section 4 above. Third party service providers’ processing of user data will always be subject to security and confidentiality obligations consistent with this Privacy Policy and applicable law.

Other sharing

In addition to the above, we may also share your information with third parties for these limited purposes:

To allow a merger, acquisition, or sale of all or a portion of our assets; To an entity managing our assets, such as a receiver in bankruptcy or liquidation proceedings; To respond to legal process (e.g. a court order or subpoena), if we believe in good faith that it is necessary to do so; To comply with requirements of mandatory applicable law; To protect the safety of any person; To protect our rights and property, including to enforce the Terms of Use and this Privacy Policy; To address fraud, security or technical issues; and If you expressly opt in to such sharing.

You agree and understand that the privacy policies of the relevant third party with whom we share the information will govern all use of information that we provide to it or that it collects from you.

We may share your information, including, (gender, age, location), usage of the Platform and device information, in a de-identified and/or aggregated format, with business parties, advertisers and/or other third parties in order to analyze the usage of the Platform and/or services, improve the Platform and/or services we provide, market our services or for other similar purposes.


All information gathered on the Platform is stored within a database accessible only by us and by the third party vendor operating such database. However, as effective as any security measure implemented by us may be, no security system is impenetrable. We cannot guarantee the complete security of the database. The servers containing your information would become accessible in the event of a security breach. In addition, we cannot guarantee that information you supply would not be intercepted while being transmitted to us over the Internet. Also, transmissions via the Internet and mobile networks are never completely private or secure. Your password protects your user account, so you should use a unique and strong password, limit access to your computer and browser, and sign off after having used the Platform. While we take reasonable data protection precautions, no security measures are completely secure, and we do not guarantee the security of user information at any time.

We will retain your personally identifiable information until the earlier of (i) the information is no longer necessary to accomplish the purpose for which it was provided; or (ii) you delete your account through your account settings. We may retain your information for longer periods to the extent that we are obliged to do so in accordance with applicable laws and regulations and/or we reasonably believe that retaining the information is necessary to protect our legal rights or legitimate business interests. Even if you delete your account, it is possible that your information may still show up in some internet search results for a short while afterwards, if the search engine maintains a temporary cache of web pages. Search engines' caching processes are outside of our control and therefore we cannot be responsible for any information that remains cached by search engines after that information has been removed from the Platform.


The Company is strongly committed to protecting the safety and privacy of children who visit the Site and/or use the App. We do not knowingly collect personal information online from children under 13 and neither the Site nor the App is directed towards or intended to be used by children under 13. We encourage all parents to talk to their children about online safety and to monitor their children’s use of the Internet.

The Site and/or the App may contain advertisements provided by third parties and may feature Third Party Applications and/or links to other websites. The Company has no control over the privacy practices or the content of such Third Party Application and cannot be responsible for them. We recommend you carefully read the privacy policies of each Third Party Application you visit or use.


If, at any time, you prefer not to receive further e-mail communications from us, you will have the ability to unsubscribe from such communications by means of a link provided in every broadcast e-mail that we send to you. Under California Civil Code Section 1798.83, California residents have the right to receive, once a year, information about third parties with whom we have shared information about you or your family for their marketing purposes during the previous calendar year, and a description of the categories of personal information shared. Neither the Site nor the App supports Do Not Track at this time. Do Not Track (DNT) is a privacy preference you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page.
